Both restaurants are operated by:
BLAKDAK M.GRECZKA SPÓŁKA JAWNA
ul. Poselska 22, 31-002 Kraków
KRS (National Court Register) No.: 0000783792
NIP (Tax ID) No.: 6762565608
REGON (Statistical ID) No.: 383264305,
hereinafter referred to as the “Service Provider” or “BLAKDAK”. BLAKDAK’s registration details are consistent with current public registry data. The addresses and contact details of both restaurants also correspond to the information published by the restaurants. These Regulations apply to reservations for which BLAKDAK makes final confirmation conditional upon the Customer making a prepayment or reservation fee payment using an individual payment link sent to the Customer.
A reservation may be made, in particular, by telephone, via e-mail, through the Restaurant’s form or reservation system, or in another manner agreed upon with the Restaurant.
Merely submitting an inquiry regarding table availability does not constitute the conclusion of a contract or a guaranteed reservation if the Restaurant has informed the Customer that payment is a condition for confirming the reservation in question.

§ 2. Definitions

Customer or Guest – a natural person, a legal entity, or an organizational unit making a reservation at one of the Restaurants.
Consumer – a natural person performing a legal act with BLAKDAK that is not directly related to their business or professional activity.
Restaurant – Czarna Kaczka or Złota Kaczka, as applicable, to which the specific Reservation relates.
Reservation – an arrangement between the Customer and the Restaurant specifying at least the Restaurant, the day and time the service is to be provided, and the number of Guests, and, where necessary,
also the scope of the ordered catering services.
Reservation Prepayment – an amount indicated to the Customer by the Restaurant prior to payment, the settlement of which constitutes a condition for confirming the specific
Reservation. Unless expressly stated otherwise in the terms of a specific Reservation, the Reservation Prepayment is credited against the bill for catering services
provided during the Reservation. Payment Link – an individual link provided to the Customer by the Restaurant, enabling an online payment to be made via the eService payment system.
Payment Operator – Centrum Elektronicznych Usług Płatniczych eService sp. z o.o. with its registered office in Warsaw (ul. Jana Olbrachta 94, 01-102 Warsaw), entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0000490970, Tax ID (NIP) 1181477610.

§ 3. Making and Confirming Reservations

Before sending the Payment Link to the Customer, the Restaurant agrees with the Customer on at least the following: the name of the Restaurant, the date and time of the Reservation, the number of Guests, the amount of the required Reservation Prepayment, and the deadline for its payment.
For Reservations requiring additional arrangements, the Restaurant may also specify the duration of the Reservation, the selected menu, the minimum order value, the method of settling the Prepayment, specific cancellation rules, or other conditions related to the nature of the specific Reservation.
The specific conditions referred to above are communicated to the Customer prior to payment and form part of the terms of the specific Reservation.
If a Prepayment is required for a specific Reservation, the Reservation is finally confirmed once the Restaurant receives notification that the payment has been successfully made, unless the Restaurant has expressly informed the Customer of a different confirmation method.
The Payment Link may have a specific validity period. The deadline for making the payment is communicated to the Customer together with the Link or in a message regarding the Reservation. Failure to make the payment by the designated deadline may result in the expiration of the payment link and the release of the reserved slot by the Restaurant, if the prepayment was a condition for the final confirmation of the Reservation.

§ 4. Prepayment Amount and Settlement

The amount of the reservation prepayment is determined on an individual basis, depending in particular on the number of Guests, the date of the Reservation, the nature of the event, the ordered menu, or the scope of services.
The Client is informed of the exact prepayment amount prior to making the payment.
All amounts quoted to the Client are gross amounts.
Payments and transactions related to the Reservation may be made and concluded in Polish currency (PLN) or the euro (EUR). The currency applicable to a given Reservation and the prepayment amount are indicated to the Client prior to payment.
Unless expressly provided otherwise in the terms of a specific Reservation, the prepayment paid and is credited towards the final bill for catering services provided during the Reservation.

§ 5. Online payments

Remote payments are processed via the eService payment system, specifically using the “Pay by Link” service.
Upon accessing the received payment link, the Customer is redirected to an online payment gateway where they can make the payment using the payment methods available at that time.
The availability of specific payment methods depends on the current offer of the payment operator.
BLAKDAK does not charge the Customer any additional fee solely for using the payment link.
The payment transaction processing service is provided by eService in accordance with the terms and conditions applicable to eService payment services.
Successful payment is confirmed by the payment system. The Restaurant may also send the Customer an additional Reservation confirmation. The current eService “Pay by Link” service directs the customer from the individual link to a secure payment environment in precisely this manner.

§ 6. Payment data security

When making a payment via the payment link, the Customer enters the data necessary to execute the payment transaction directly within the environment managed by the payment operator or the relevant payment instrument provider.
BLAKDAK does not require the Customer to send via email or provide over the phone a full payment card number, CVV/CVC code, or other data used to authorize a payment made via the payment link. BLAKDAK does not store the Customer’s full payment card number or CVV/CVC code in connection with payments made via the Payment Link.
BLAKDAK receives from the Payment Operator the information necessary to identify and settle the transaction, specifically information regarding its status, value, and identifier. This solution corresponds to the eService Pay by Link/SafeLink model, in which the Customer is redirected to a payment gateway after opening the link.

§ 7. Cancellation and modification of the Reservation by the Customer

Unless different terms have been established for a specific Reservation prior to payment, the Customer may cancel the Reservation free of charge no later than 7 days before the scheduled Reservation date. In such a case, the Reservation Prepayment is refundable in full.
In the event of cancellation of the Reservation less than 7 days before the scheduled Reservation date, the Reservation Prepayment is non-refundable, unless the Restaurant decides otherwise on an individual basis.
If the Reservation was made less than 7 days before the scheduled date of the Reservation, the Reservation Prepayment is non-refundable upon cancellation by the Customer, unless the Restaurant decides otherwise on an individual basis. For group reservations, special occasions, reservations involving a pre-agreed menu or specially ordered products, special events, or other reservations requiring specific preparations, the Restaurant may establish individual reservation terms—specifically regarding the amount of the reservation prepayment, the deadline for free cancellation, and the rules for refunding or retaining the prepayment. These terms are communicated to the Client prior to payment and take precedence over the general rules set out in this section.
Any change to the date, time, number of guests, selected menu, or scope of the order requires confirmation by the Restaurant in each instance. The Restaurant may refuse to make a change if fulfilling the modified reservation is not possible due to the reservation date, seating availability, purchases already made, products ordered, preparations already underway, or other justified circumstances.
In the event of a reduction in the number of guests, a corresponding reduction or partial refund of the reservation prepayment is possible provided the Client notifies the Restaurant of the change at least 7 days prior to the reservation date, unless different terms have been established for the specific reservation. If notification regarding a reduction in the number of guests is provided less than 7 days before the reservation date, the Restaurant is not obliged to refund the corresponding portion of the prepayment, particularly if it has already incurred costs related to preparing for the reservation.
In the event that the Client or guests fail to appear at the scheduled reservation time (“no-show”) without having effectively cancelled the reservation in accordance with these Regulations, the reservation prepayment paid is non-refundable. A reservation may be cancelled or a change thereto requested by contacting the relevant Restaurant via telephone or e-mail. The time of cancellation or the request for a change is deemed to be the moment the Restaurant receives such information.
If, pursuant to these Regulations or the specific terms of a given reservation, the Customer is entitled to a refund of all or part of the Prepayment reservation prepayment,
BLAKDAK shall initiate the refund no later than 7 days after the effective cancellation or modification of the Reservation. As a general rule, the refund is made using the same payment method used to make the Prepayment, unless the Customer expressly agrees to a different refund method.

§ 8. Failure to Use the Reservation

The Customer should inform the Restaurant of any anticipated significant delay.
The Restaurant will wait for the Customer and other Guests for 15 minutes past the scheduled Reservation time. After this time has elapsed, if the Customer and other Guests have not arrived and there has been no contact with the Restaurant, the Restaurant reserves the right to treat the Reservation as unused and make the table available to other Guests.
Failure to use the Reservation without prior effective cancellation in accordance with § 7 is treated as a “no-show” and results in the forfeiture of the right to a refund of the reservation Prepayment.

§ 9. Cancellation of the Reservation by the Restaurant

If, for reasons attributable to BLAKDAK, it is not possible to fulfill a confirmed and paid Reservation, the Restaurant shall immediately inform the Customer.
In such a case, the Customer may choose—subject to availability—to reschedule the Reservation or receive a refund of the entire unused Prepayment.
If a refund is chosen, BLAKDAK shall initiate the refund of 100% of the paid amount no later than within 7 days.
The above provisions do not limit the Customer’s rights arising from mandatory provisions of law.

§ 10. Right of withdrawal

A reservation governed by these Regulations concerns the provision of catering services on a specific day or during a specific period.
Pursuant to Art. 38 para. 1 point 12 of the Act of 30 May 2014 on Consumer Rights, the Consumer is not entitled to the statutory 14-day right of withdrawal from a distance contract if the contract concerns the provision of catering services and specifies the day or period for the provision of the service.
The absence of the statutory 14-day right of withdrawal does not deprive the Customer of the possibility to cancel the Reservation and obtain a refund of the Prepayment in accordance with the rules set out in § 7 of these Regulations.

§ 11. Complaints

The Customer has the right to lodge a complaint regarding the Reservation, its fulfillment, the settlement of the Prepayment, or other actions taken by BLAKDAK in connection with the Reservation.
A complaint may be submitted via e-mail: for Czarna Kaczka – info@czarnakaczka.pl, for Złota Kaczka – info@goldenduck.pl, or in writing to the following address:
BLAKDAK M.GRECZKA SP.J.
ul. Poselska 22
31-002 Kraków.
To ensure the efficient processing of the complaint, it is recommended to provide the Customer’s full name, the Restaurant name, the date and time of the Reservation, details enabling the identification of the payment, a description of the issues raised, and the expected resolution.
Providing the above information is not a condition for the effective submission of a complaint, provided that the subject matter of the complaint can be determined based on the information submitted. BLAKDAK shall provide the Consumer with a response to the complaint within 14 days of the date of its receipt. The response shall be provided on paper or another durable medium, specifically via e-mail.
If the complaint concerns solely the technical execution of a payment transaction processed by eService, the Customer may also utilize the payment operator’s complaint procedures.
The current Article 7a of the Act stipulates a 14-day period for the entrepreneur to respond to a consumer complaint; failure to respond within this period constitutes acceptance of the complaint.

§ 12. Personal Data

The controller of personal data processed by BLAKDAK in connection with the making and handling of a Reservation is BLAKDAK M. GRECZKA SPÓŁKA JAWNA, ul. Poselska 22, 31-002 Kraków.

Data may be transferred to entities providing services to BLAKDAK that are necessary for handling reservations, IT systems, accounting, and payments, solely to the extent necessary to fulfill these purposes and in accordance with applicable law.
With regard to data processed in connection with the provision of payment services, eService processes data in accordance with its own obligations arising from regulations concerning payment services and personal data protection.

The data subject also has the right to lodge a complaint with the President of the Personal Data Protection Office.
Providing the data necessary to make a Reservation is voluntary; however, failure to provide such data may make it impossible to make or fulfill the Reservation.
§ 13. Out-of-court dispute resolution
BLAKDAK strives, in the first instance, to resolve any disputes related to the Reservation amicably.
After exhausting the complaint procedure, the Consumer may avail themselves of legally available out-of-court methods for resolving consumer disputes, including assistance from the competent provincial inspectorate of the Trade Inspection (Inspekcja Handlowa) or other entities authorized to conduct out-of-court consumer dispute resolution proceedings.
Up-to-date information regarding entities authorized to conduct out-of-court dispute resolution is available through the Office of Competition and Consumer Protection.
§ 14. Final provisions
These Regulations are made available free of charge on the Restaurant’s websites in a manner that allows them to be read and saved.
The Regulations applicable to a specific Reservation are the Regulations in force at the time that Reservation is made.
Amendments to the Regulations do not affect the rights and obligations arising from Reservations confirmed prior to the amendment taking effect, unless the amendment results from mandatory provisions of law or the Client and BLAKDAK agree otherwise. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and regulations concerning personal data protection.
No provision of these Terms and Conditions is intended to exclude or limit the Consumer’s rights arising from mandatory provisions of law.
In the event of a conflict between a provision of these Terms and Conditions and a mandatory provision of law, the latter shall prevail.
The court competent to resolve any disputes shall be the court determined in accordance with generally applicable provisions of law.
These Terms and Conditions are effective as of September 22, 2026.
